Escher-Grad Technologies Inc. Wins Domain Name Dispute against Fraudulent Website Owner

Montreal, Canada - December 21st, 2005 -- Escher-Grad Technologies today announced that it has won the domain name dispute against the owner of the fraudulent websites that were representing themselves as Escher-Grad Technologies Inc. The domain names, www.eschergrad.com and www.cobaltctp.com, (both WITHOUT hyphens) were, at various times, displaying slanderous information about Escher-Grad and its executives, implying Escher-Grad was out of business, and redirecting unsuspecting visitors to a variety of alternate sites including other CTP manufacturers’ sites without the other manufacturers’ knowledge or consent. The judgement was issued on November 25th, 2005 by the World Intellectual Property Organization, the ruling body for all domain name disputes. The formal domain name transfers to Escher-Grad were completed on December 15th, 2005.

The WIPO Arbitration and Mediation Centre’s findings showed that Escher-Grad had proved all three elements required for the transfer or cancellation of a domain name including: (i) that the disputed domain names are identical or confusingly similar to a trademark or service mark; (ii) that the owner has no rights or legitimate interest in respect of the domain names; and (iii) that the disputed domain names have been registered and are being used in bad faith.

Both of the fraudulent websites were dormant while the case was before the WIPO panel. Escher-Grad, now the owner of both, will leave them dormant to avoid any confusion that may arise from their re-activation.
